Legal Question in Family Law in Texas

Divorce & Assets In Texas?

I & my wife have decided to get a divorce some day soon. We live together now, have a 3 year old, and have a real estate investment company we own that owns 3 rental properties. With my share of our cash, I am now still buying other properties to rent, and would (pre-divorce) like to form a company that she cannot have any part of after the divorce. I want those new assets to benefit our 3 year old if I die. Will I be required to give her half of those assets? Could her attorney find those assets, and make me pay here some kind of money from them? I plan on trying to get at least 1/2 custody of our son, and plan to fully support him in every way. I want her to be able to collect what is due her for the company we started, but my real concern is that she is very bad with money, and I need to find out my options. Thank you for any help anyone can provide...Levi

Re: Divorce & Assets In Texas?

You know that she has a community propertry interest in the present company. Any property acquired during the marriage is presumed to be community property, so the new company would be subject to that claim (likely successfully). You would be better off to wait, but most importantly with these kind of assets and these kind of questions, you should consult a lawyer instead of seeking assistance over the internet.
