If i cash a cashiers check with my current husbands name on it only will i get in trouble for it. while we are still legaly married?

In order to cash the check it will need to be endorsed. If you endorse the check with his name it will be forgery unless you have a power of attorney he has signed authorizing you to do so.

I suggest you talk with an attorney concerning the circumstances of your particular case.

Somehow I get this feeling that you are not going to be legally married for long. Somebody, somewhere is going to get in trouble for a forged endorsement. The criminal penalty for forgery is felony convictionand up to 10 years in prison. First offenders sometimes get probation. Good Luck.
