Legal Question in Family Law in Texas

Divorce - Change of Beneficiaries

My son and his wife are getting a divorce. Can my son change the beneficiaries on his life insurance policy naming only his children, or does he have to wait until the divorce is final?

Re: Divorce - Change of Beneficiaries

Texas courts now issue standing orders at the time the Petition is filed. Those orders vary somewhat from county to county, but will specifically require both parties to maintain the status quo, unless there is an agreement or court order to the contrary. Which means that this can be considered a gray area, and he shouldn't do it, without discussing it with his lawyer first. It is certainly possible to get a temporary order allowing the changes, if the wife is opposed. It is also a valid issue for discussion at mediation.
