Legal Question in Family Law in Texas

Divorce and Child Custody

I have several questions.

1. What does ''primary parental custody in any geographical location'' mean?

2. Can that wording be in the same divorce decree/custody agreement that gives the non custodial parent visitation rights?

3. If so and the custodial parent wants to move out of state with the child, do both parents have to come to some agreement then go back to court and have the visitation changed?

Re: Divorce and Child Custody

1. That is not standard language in a Texas divorce decree. It would be subject to the court's interpretation. I read it to mean that there is a primary and possessory conservator, and the primary conservator is not restricted to any particular residence. 2. Again it is not standard, but if there is a designated possessory conservator, then it does not negate that. 3. Again, that language about 'any geographical location' is troublesome, and appears to give the parent the right to go anywhere, without anyone's permission.

The decree needs to be modified/clarified.
