Divorce & child custody

My son & his wife may get a divorce. Is there a law in Texas that states the one who keeps the child the most before the divorce will get custody?

There is a presumption that both parents have equal rights. There is also a presumption that everyone is innocent. The truth is that the one who is most willing to fight for the primary custody will win. The real truth is that parents who think in terms of the best interests of the child will work out their problems. Any time custody is in dispute I suggest both parties hire attorneys and get ready to go to parenting classes and mediation. I also suggest that each party interview attorneys until they find one they are comfortable with. Each side should have a hefty check book balance because the court may well decide to do social studies and have the parents pay for an attorney to represent the children themselves. Parenting classes are an important first step and most Texas judges require them. Good luck.
