Divorce with a Child
My husband and I are seperated and I want to divorce him.I was in an abusive relationship and have a 22 month old little girl.He was acting out this behavior infront of her as well. Verbal, Mental, Emotional and physical abuse as well as idle threats. He was drinking alot and has ADD and ODD. I have proof My husband and I have talked and he has no problem of me wanting a no fault divorce and going to back to CA. I live in Texas do not work. I am a stay home mother and have been since the day I gave birth to my daughter. My family resides in CA and that is where I want to be at. My mother is gonna be supporting me so I can get back on my feet. I would like custody of my daughter. Last when I spoke with my hubby he said he wanted Standard Visitation. Every other holiday. Well now CPS and APS are involved with my husband. I have a plan order from them he's to have no unspervised contact of any kind with my daughter. We've been seperated for almost 6 weeks. How should I go about this?

You need to retain a local Texas attorney to assist you with the divorce. Once the divorce is completed and the child custody, visitation, and support issues are addressed in the decree, you will know where you stand. Getting a lawyer would be a good start. Either that or start studying law. This stuff isn't as easy as it looks on television. You've identified several factors which should be in your favor, but the court doesn't care. The court has to be satisfied with facts and legal authority. Good Luck.
