I have a small business (C-corp) and plan to get a divorce. The business has two bank notes that are also personally guaranteed. I also have several personal credit cards that are used for both personal and business expense. Will the courts consider these debts in determining my net worth for the divorce?

These are questions which should be discussed with a private lawyer in a private setting. For a court to consider property and debt, proper evidence must be offered and admitted into evidence or the court won't consider the evidence. Such matters as the character of the property, the evidence supporting tracing and the nature of the debt can be considered.

In a more general term, if you were purchasing all of a person's assets or all of a company's assets, would you consider that debt in making a purchase decision?
