Legal Question in Family Law in Texas

Concerning Divorce

Dear Lawyer,

I have a few questions concerning my brothers marriage. He and his soon to be ex-wife are in an ongoing battle over theyre possesions. She left the country a few months ago with their kids, and left him with nothing but theyre car. The car is under her name, but my brother payed for it, and now she wants to pass the car onto somebody else. Does my brother have any right to claim the car even if it's under her name?

Another thing that's been brought to my attention is that she left with both of theyre kids to another country. The kids were born in Texas. Is she allowed to abandon her husband and take the kids with her without his consent? Even after their divorce comes through, will she still be allowed to drag the kids with her to another country?

Thank You!

Re: Concerning Divorce

Your brother desperately needs an attorney.

If the mother and children left less than 6 months ago, he can file for divorce in Texas.

After he consults with an attorney, he might find out that he can get custody of the children.

Please encourage him to immediately retain an attorney.

If money is an issue, he can try free legal (pro bono) legal services. Unfortunately, most are overwhelmed.

He can also try looking at the attorneys on this website. Most offer a short free phone consultation.

He might also check the free newspapers in his city (in Houston we have one called the Greensheet) that list attorneys.

He needs to act NOW!
