Legal Question in Family Law in Texas

The divorce decree states that each person shall keep the property they have control of at the end of the case. The man has the house and makes payments for ten years after the divorce is final. He never took the woman's name off of the loan. He has died now after ten years. Should his ex-wife still get half of the house?

You'll want to take a good close look at the decree. Usually, real estate is specifically dealt with - specifically awarded to one party or the other.

Whose name is "on the loan" means nothing. Whose name is on the deed?
