Divorce

My divorce decree states that I use my son as a deduction and claim him as a dependent. However, I just found out that my husband claimed him and of curse - he can't be claimed on two tax returns. What can i do ?

Show your decree to the IRS, as well as your receipts indicating that you pay over 51% of the child's support.

Then show your decree to the judge, subpoena the ex's tax return, and ask the judge to hold him in contempt and pay your attorney fees.

Check with the IRS before you file your return. This is probably a common issue and they may have a standard solution.
