Legal Question in Family Law in Texas
divorce
I was divorced last year. Under the divorce decree we divided our debt. I paid for one credit card and he was suppposed to pay another. The cards are both under my name and he has has been paying his debt. Creditors are calling me for the payments. My divorce lawyer said i can not do anyting until the credit company sues me then i can countersuit my ex-husband. I feel i am in a no win situation and that my divorce decree is worthless. What can i do? I do not want to pay what he is supposed to pay.

Re: divorce
Since you signed the agreement with the creditor, you owe the money to them unless they release you which is very unlikely.
1. Wait until the company sues you and then bring in your ex. The problem with this option is that interest charges and attorney's fees will increase the debt which you will owe.
2. Your ex could borrow the money (perhaps on another credit card) and pay off the debt.
3. You could pay off the debt. When you do you could sue your ex.
4. If you qualify, you could file bankruptcy.
Dividing debts is a big problem with divorces.
