Legal Question in Family Law in Texas

divorce

I'm considering divorce due to verbal abuse. Should I refinance a house I purchased before I married my husband 3 years ago. I owe 172,000 and it's worth 190,000. We owe 17,000 on a Yukon vehicle that's also in my name only purchase during marriage. He has equally contributed to the mortage payments and car payment. I don't want to loose the house in the divorce. Is it possible for him to keep the Yukon and I keep the house. We have no children. Thank you.

Re: divorce

Since you purchased the house prior to marriage, it is your separate property. The community estate might owe some reimbursements to him if there were improvements. The debts and assets you acquired during the marriage are community, and absent some compelling reason, will be split 50-50. You can reach an agreement with him as to the division of property, or let the judge do it.
