Divorce

I have been estranged from from a man for 7 years. I would like to file for divorce, which would be a 'simple' uncontested filing. There are no children under 18 years and no assets. When filling out the the Divorce Petition it is asking for the Respondents name on the birth certificate. I know the birth certificate name is different than what he has always gone by, even though this was never legally changed, because his mother remarried when he was a child. Can I claim we were never married because of this, therefore a divorce is not required?

That's kind of contorted thinking. Whatever the name is does not change the fact that you were married to the guy and have a marriage certificate to prove it. If he has another name include that in the divorce. Good Luck.
