I filed for my Divorce a little over three years ago, it is still an open case. 1 and a half yrs later she files child support and i have been paying since then, we have no property disputes its very cut and dry since custody and child support all already taken care of, My question is , I have not seen my wife nor my child for over a yr can i file Desertion?

Based on your zip code, it sounds like you live in Harris County, Texas.

I find it difficult to believe that you have an open divorce that has been pending in the Family Courts of Harris County for over 3 years.

Call the Harris county Clerk's office at 713-755-5758 and give them your cause number or your name. They can tell you if it is still active. It might have been dismissed for want of prosecution (also known as "dwop'd").

Regarding desertion -- I would encourage you to talk to your attorney or if you don't have an attroney then you need to talk to an attorney so that the attorney can to determine what you are trying to accomplish.
