Divorce filing expiration...

I was married by common law in

Denton county, Tx. When we

seperated, my ex filed for divorce. It

has now been sitting with no progress

or even attempt at progress for nearly

2 years. I know that if she hadn't filed,

our common law status would've

already expired. Is there some kind of

expiration on that filing if nothing is

done, or does it have to be

completed?

The court computer system usually picks up cases that have no activity and sets them on the dismissal docket. If neither party appears for the dismissal docket hearing, the case is dismissed. It is very unusual for a case to be pending 2 years without being set for dismissal.

I suggest you check the status of the case with the on line website for Denton County to be sure the case is still active.

If the case is active, have the court coordinator set it on the dismissal docket or ask that it be set for trial.

It would be a good idea to hire a lawyer.
