Divorce with full blown Protective Order
I and my two children have been displaced from our home for now nearly 3 months. I was a stay at home Mom. I went through the D.A.'s office and applied and received a two-year Protective Order against my husband for myself and my two children. I also went through H.V.L.A. to receive legal-aid and I am awaiting a response from them. I just got served Divorce papers from my husband this past weekend. Although I am happy since this will expedite the process, my question is he is asking for custody of both children of which one is mine before our marriage and he has no rights to as well as for me to pay child support to him. What are my rights since I and my two children have been displaced and are victims of domestic violence as well as have a protective order in place to protect us from my husband?

With a protective order in place, it will be difficult for him to get custody in Harris County. I won't say impossible (since we have a case in our office where he got custody and she has a p.o. against him) but it does put an extra burden on him.
You really need an attorney to represent you.
