Legal Question in Family Law in Texas

Divorce / House

My husband and I have been married for 20+ years. He has a sever gambling problem and is unable to keep a job for more that 2-3 years. He has declaired bankruptcy twice and is in credit card debt right now up to $4000 or more. I have woked at the same job doe 14 years and sperated all my finances from him several years ago. We refinanced our house which we bought in 1994 about 6-7 years ago and because of his terrible credit the mortgage is in my name only. I have managed to hang on to the house by working hard and putting a little money away for each time he has lost his job or gambled it away. Is there any way for me to be granted the house in a divorce so that I don' have to sell it and move myself and my sons into an apartment?

Re: Divorce / House

Yes there is. Properly presented, a judge just might consider that he has gambled away his community property share of the house. Not guaranteed but worth a shot. Good Luck.
