my husband and i have been apart since dec of 98. we got married in jan of 98. i want a divorce cannot afford a good lawyer but i need my divorce. what can i do to obtain my divorce and have it where he cannot touch anything i have vested in. my kids are my beneficaries. we have no kids together. when he left he took what he wanted. we have no legal separation papers and he has been living with another female for about 2 yrs now.

I offer DO IT YOURSELF DIVORCE kit for people in Harris County for $195 with all the county and state forms.

I don't have any forms for your county. However, if there are no kids and no property to divide, then call him and see if he'll sign the papers.

If so, we could probably do it via phone and email. You would have to mail me a check or money order for $175 (discount since I won't have any county forms) and when it clears the bank, I'll do the paperwork and email or fax them to you. I've done it before. I prefer to meet people face-to-face.

Then you pay the county filing fee for your county. Probably around $250. You can call your county clerk and find out how much and were you need to file the paperwork.

I am not sure what you mean that you cannot afford a good lawyer. Many good attorneys will accept a reasonable retainer and monthly payments. Since you have been apart for 10 years, it is unlikely that you have much to still contest. You will need to be careful, since what the two have you have accumulated over the past 10 years is considered marital property. Keep exploring the option of retaining an attorney.
