Divorce
My Husband and I have been married 11 years, He is now eligible for the drop program through the Houston fore Dept. He has asked me to give up my rights to his drop Money, He states We have to file for Divorce asap because the longer we wait the more money I will get and he feels i do not deserve his drop Money. After the Divorce is final he states we can re-marry but I have to sign a prenumpt. Do I have any rights

Take your share of the drop money right now and wave goodby to this creep. With your share of this drop money, maybe you can find a better husband. Good Luck.

Any time someone says "we need a divorce" for reasons other than getting a divorce I'm suspicious. Maybe that's just 25 years practicing law talking, but I think you need a good lawyer.

What rights do you have?
You have the right to AT LEAST 50% of all the assets since the date you married -- other than gifts and inheritance.
Anything you received as a gift (perfume, jewelry, etc.) is also your separate property.
You must also share 50% of the debts -- unless he spent the money on a girl friend or some other reason where only he benefitted.

If you file for divorce, you get 1/2 the drop. Sounds like you need to lose him anyway. I am in Louisiana, but Texas is a community property state like ours.

You're probably going to need an attorney in Harris County. Texas is "no fault" so if he wants a divorce he's going to get it. You need someone to protect your rights!
If he is just now eligible for a DROP account there's probably nothing in it yet, but that doesn't mean you don't have a claim against his retirement.
