Legal Question in Family Law in Texas

RE: Divorce

1. My ex husband has not paid childsupport for 1 month. Do I have to turn my 3 kids over this weekend to him. If I don't what will happen.

2. I was forced out of my house since it was getting foreclosed on. My ex did not pay the morgage for a couple of months which in my divorce decree it shows he is suppose to pay alimony of the morgage and child support. If I take him back to court what are my chances of fighting for getting my alimony back again. He stopped paying last May of 2008 for alimony. It says in my divorce decree I lose my alimony if my house sells but it got forclosed on and he is living in another house with his new wife.

Re: RE: Divorce

Paying child support is not a condition for getting visitation. They are two entirely separate orders of the Court and one is not dependent on the other. If you don't allow visitation you are risking going to jail.

As for the rest of your problems, you need to go sit down with a good family law attorney immediately. You should have done this back in May or June. Good luck!
