Re: My divorce
After a separation of 7 years, it is likely that you have already resolved your property division issues. Many attorneys have reasonable flat fee rates for an uncontested divorce, and you should explore that as an option. You have the right to (approximately) 50 percent of the assets and debts acquired during the marriage, as well as conservatorship and support for the child.
Re: My divorce
Based on what you have written, it appears that you and your spouse have distributed all of the community assets and debts. Generally, both parties to a divorce are entitled to 50% of the community assets and debts. As for child(ren), generally, both parties will have an interest in controlling the child(ren)'s up-bringing. One party will be given the exclusive right to designated where the child(ren) live. Re: My divorce
If you do not know where your spouse is, you are really going to want an attorney to help you through the process. If you do know where he is and he will sign off on the divorce you may still want the assistance of an attorney given the age of the child support order.
If you would like to call my office and set up a consultation, I'll be happy to discuss your situation with you.
