Divorce - Income Tax Return

My son and his wife were separated during the entire year of 2008. Their divorce is still pending. His wife is not employed and has not been employed for several years. Is my son entitled to receive all of the tax refund for 2008?

They are still married and Texas is still a community property state. Legally, it's half hers.

If your son wants to know these things, he should be asking his attorney. His attorney has all the details of this divorce and is in the best position to give accurate answers. If he doesn't have an attorney he should get one because these sounds fairly complicated.
