First you must file an Original Petition that includes the proper category of discovery under the Texas Rules of Procedure and pay the filing fee. Then you must either formally serve the opposing party by process server, or obtain a waiver or formal Answer from the opposing party. Then you must type your proposed final order, and either obtain the opposing party's signature in agreement, or set it for a contested trial. After the final order is entered, there are also issues of transferring various types of property, such as filing new deeds for real estate and obtaining a court order regarding division of retirement plans. It is highly recommended that you hire an attorney, because there are many technicalities along the way.

However, I'd back up a bit. Are you sure you want a divorce? Can the problems be resolved by marriage counseling?

My next concern is safety. A friend of mine was killed by her husband when he found her packing and then he killed himself. Their 6-month old baby was left an orphan. Safety is always a major concern of mine.
