Legal Question in Family Law in Texas

Divorce - International Relocation

My spouse and I are resident aliens living in the State of Texas. We are both British citizens and have lived in the U.S. since 1999 and Texas since 2004. My daughter (11) was born in Germany and my son (8) was born in the U.S. We are currently separating and my wife has threatened to return to the U.K. with our children. Can she legally do so? What rights, if any, do I have?

Re: Divorce - International Relocation

Get a lawyer immediately to file on your behalf. The judge will issue passport restrictions, as well geographic restrictions, if warranted.

To get an idea of where you stand, you should download and read this case: Lenz v. Lenz, 79 S.W.3d 10 (Tex. 2002). The case number is No. 01-0232 and the exact date is June 6, 2002. You can locate and download it from the Texas Supreme Court's website. I'd give you the URL but lawguru.com strips them out of messages.
