divorce issues

i have it in the divorce where I would pay my ex-wifes car payment, in return I have custody of my son and she has not seen him in months. I am starting a new career out of state and need to limit my expenses for the time being. What would happen if I were to not pay the car payment?

First, her failure to exercise visitation is unrelated to the car payment.

Failure to pay the car payment may cause her to file a Petition for Contempt -- and you could have far more damages than the car payment.

Secondly, before you make plans to move, does your decree have a geographic restriction? They are pretty standard these days. Even without one, the judge may favor restricting the child's move, in a modification. In such an event, her failure to exercise visitation would be a relevant factor.
