Legal Question in Family Law in Texas

Divorce 401k separation

I was divorced in 1998 in Texas and was awarded part of my husbands 401k account. I never filed the forms. Am I still able to collect this money?

Re: Divorce 401k separation

If you were awarded the 401(k) in the Final Decree of Divorce, you can file the paperwork and have the judge sign the paperwork to send to his employer(s).

It would have been easier to do the paperwork at the time of the divorce, but you should be able to get it signed by the Judge if the Final Divorce Decree was prepared properly.

If not in the decree, then you have serious problems.

Good luck!
