Legal Question in Family Law in Texas

Getting divorce and my kid has not my nationality

I am mexican, my husband is canadian, now we are living in USA. I do not have status neither in Canada or USA. Now we are getting divorce and my husband is trying to keep me in USA, where I can not work, have driver license or take my girl, who is a canadian citizen, to Mexico with me. My question is if I can go to back to Canada and make a refugee claim? I am thinking that if my kid is canadian and she is in there then he can not take her away from me,am I rigth? Please I need advice asap! Thanks

This is way, way too complicated for an email. You need an attorney who does both family and immigration law.
