Legal Question in Family Law in Texas

divorce and kids

My fiance is not yet divorced but has tried many times to do it on his own. My ques is for a divorce to take place do you have to state in the decree anything about kids? The deal is my fiance's kid which is now 14 has been with him all along since he was 5. His Mom basically does not want him so my fiance has been raising him. Now we want to get married and he needs to get a divorce from his wife. Both of them have moved on and my fiance has never made his son's mom pay him child support and the deal is even if they put in the decree that she needs to pay something for CS she won't so does this mean that they can'y get divorced?

Can't figure out in 9 years how to get a divorce? Maybe now is the time to hire a lawyer. Seems like everybody would come out a winner like that rather than trying and not getting it done.
