divorce and kids

My fiance's is trying to get a divorce from his wife. They have been seperated for many years, have one son together(age 14). His wife however has had a baby with another man. They are not married. For my fiance to divorce his wife do they have to mention the kid by the other man in the papers? Also, the 14 year old lives with his dad and the dad does not want anything from the mom.

Of course you have to tell the court. Remember how it starts on TV - "Do you swear to tell the truth, the whole truth and nothing but the truth"? That doesn't mean you get to pick and choose what you think the truth is. Courts get very nasty when little details such as children are left out of the divorce.

The child by another man is not part of the marriage relationship and therefore CANNOT be made part of the Suit Affecting the Parent-Child Relationship (SAPCR) part of the law suit.
