Legal Question in Family Law in Texas
Divorce Kit
Thank you in advance for your time. I went online to get a ''divorce kit'' and I am puzzled. They sent me a form TX-Do-10. I was under the impression that this would include all forms I needed to file on my own behalf. From reading the forms it leads me to believe that the TX-DO-10 is only to be used after you acually file for the divorce. Can I file the initial paperwork myself without retaining lawyer? If so where do I get them?
Sincerely

Re: Divorce Kit
I have never heard of a TX-DO-10.
No other attorneys hve posted because I suspect they are laughing too hard to type!
I hope that everyone reads my post and will take me seriously...
THE KITS YOU BUY AT OFFICE SUPPLY STORES, ETC. ARE JUNK!
I have never seen a COMPLETE KIT that will work in the Harris County Family Courts. There might be one but I've not seen it. If you have one, please let me know!
If you don't believe me, go look one of the kits (I have one on my bookcase compliments of a client that read the fine print after she bought it!) On the cover it states (I'm summarizing) no state forms included. It costs approx. $40 and is a complete waste of money and time.
If you want to do a divorce without an attorney, go to a local law library. Many have books that contain forms to assist you in doing the divorce.
If you want to know what forms you need to get divorced in Texas, go to law school. In 3 years or so, you will be able to do your own divorce.
If you do not have kids or any property and/debts, a divorce in Texas is not too difficult. The costs should be under $1,000.
If you have kids, it is my opinion that you need an attorney to do the paperwork required by the courts.
After doing this over 10 years, I have found that folks that try to do things "cheap" usually pay MORE that folks that hire an attorney and do it right from the get go.
Footnote: I offer a Do It Yourself Divorce class for people with no kids, no property, no debts, and both parties are in agreement about the divorce. I watch you prepare all the paperwork. I give you the necessary instructions to get a divorce in Harris County, Texas.
