Legal Question in Family Law in Texas

Divorce Law

I have a lien against a house that was granted to my ex-spouse in the divorce. I believe he is planning to allow the house to go to foreclosure. Will I still get my money?

Re: Divorce Law

Only if there is sufficient monies left over after the foreclosure sale to satisfy the costs of the foreclosure and the balance due the first lienholder. As a second lienholder, you would then be paid, if there are any remaining funds. Have you considered contacting te first lienholder and attemting to negotiate with them?

You need to get a family law attorney to look at the terms of your decree and the lien. They will tell you if there is anything you can do prior to foreclosure by the mortgage company.
