Legal Question in Family Law in Texas

Divorce

can I be made to pay my wife's truck note and Insurance after we are divorced. There is no property to be divided.Right now and for the next several months I am drawing workmans comp.due to injuries on the job.I am and have been paying her truck notes. But I do not want to keep on paying them. She makes more money than I do as it is.Can you tell me what my options are. This is all that is holding up the divorce. Her lawyer is holding up things so I have to keep paying the notes on my wifes truck.I am on my second lawyer and he is no better than the first one.No one will set a hearing date and I am so frustrated and sick of all this mess.I just want a DIVORCE with no stings.

can you tell me anything to help me.

My divorce has been filed since March 9th.2007. My wife filed hers the 23rd.of Feb.2007.There is no sense in this dragging on any longer. Please tell me something I can do. Thanks So Much

Re: Divorce

If you did not sign the note or guarantee it you are not responsible for the payments.

If you are on the note, make sure your lawyer has the court order your wife to either convey the truck to you or refinance the loan so you are not on the note.

Another option is to tell your wife you can no longer afford to make the payments and will stop making them. She either needs to arrange to take over the payments or watch the truck be taken away. If you are on the note, this will hurt your credit rating.

If you are on the note, the creditor will continue to hold you responsible unless it is paid off so make sure your lawyer has the court order your wife to either convey the truck to you or refinance the loan so you are not on the note.
