Divorce
Married since May18, 2002. He wants a divorce. We just bought a home. No equity in in the yet. What am I entitled to? Can he kick me out?

As a matter of law he can not "kick" you out of the marital residence. If he tells you to leave do not leave, and ask him to leave instead.

You would be entitled to half of what both of you earned since you got married. Since Tx is a community property state you can split whatever you or he earned and accumlated over the last 8 or 9 months. No alimony is allowed in Texas. If you have kids by him then you are entitled to child support.You don't need to worry about the house if it has no equity..might be best to dispose it off when you are still with him as opposed to assuming the liablity of it.

Home purchased during marriage in Texas = community property, regardless of whose name is on the note. Neither of you can kick the other out. In the divorce, you are entitled to 50% of all assets & wealth accumulated during the marriage and so is he.
