Legal Question in Family Law in Texas

Divorce

I was married in Mexico last fall but haven't changed names or applied for marriage license or done anything to make it official in the US. I caught my wife of now 6 months being unfaithful last week and want to divorce her. We have purchased a house together, and it is in both our names. I'm planning on having her removed from the mortgage and keeping the house. I'm not concerned about her getting nasty towards me, as she knows it was her fault and is very sorry. We both would like to handle it without going to court. I've offered her anything she needs in the house within reason and to help with some of her credit card debt. Is there anything we have to do legally, since we're not on paper in the US? Neither of us would ever live in Mexico. Do we need to do anything there?

Re: Divorce

Your legal marriage in Mexico is legal in the US. You have acquired community property together. I doubt that you will be able to just "take her off the mortgage". That is a property interest. You're married. If you don't want to be married, you'll have to get a divorce. If you don't get a divorce and get married again, it's bigamy. Good Luck.
