want divorce , he paid for plane tickets

My husband was staying out to the next day and finally i had enough. He expected my not to be upset or angry, but I had had enough. He had also got in my face yelling at me in front of our son, as if he was going to hit me, and I am 95% sure he would have( if he didn't send us away). I told him I wanted a divorce and then the next day he sent my son and I on the plane to texas. It has been two months, when can I file for divorce and what will happen with the custody? He doesn't send any money or anything for our child?

You must be a resident of Texas for at least 6 months and live in the same county for at least 90 days before you can file for divorce.

In the meantime, you or he can file in the state that he currently lives in and that was the last place you lived together as husband and wife.
