Legal Question in Family Law in Texas
Divorce during pregnancy
I am in the process of filing for a divorce, however, my wife claims she is pregnant. She has not provided any proof of this claim, and I believe she is lying to delay the process. I am fearful to file the documents I have prepared for a divorce w/ no children. I do not have an attorney, and I don't plan to employ one. My question is this: can I demand proof of this supposed pregnancy from a physician in order to file the appropriate paperwork, or will I be denied proof because of HIPAA laws? Also, if my wife is pregnant, I believe the child is not mine. I know the court will presume I am the father--is there any way she can be ordered to provide proof of paternity, or does that responsibility fall on me?

Re: Divorce during pregnancy
I know you won't like this answer, but you need an attorney. From the questions you are asking, you don't have the knowledge to handle this yourself. Messing this up could end up costing you many, many times more money than a good attorney will.
