Legal Question in Family Law in Texas
Why is the divorce proceedings in default?
Non-contested Divorce papers have been filed with the court. The first court date was cancelled due to the other party (out of state)sent a letter to the court. The letter stated that the divorce is not contested. Told now that we have to wait for a trial date because we are in default. If the other party sent a letter to the court stating the divorce is not contested, why isn't the divorce considered a non-contested divorce? Do we have to wait for trial since we have the letter?

Re: Why is the divorce proceedings in default?
I think the Judge is considering the letter an "Answer" and therefore the "default" divorce is no longer an option.
You do have other options now, but you need an attorney to help you.
