Divorce by publication

What is the process of a divorce by publication? And is there a deadline for the divorce to be finalized once the case has been filed?

A divorce is like any other lawsuit. The other party must be served with a copy & permitted the opportunity to respond. If the other party cannot be found, the lawsuit is published in a newspaper of general circulation - at your expense. Costs about $600-$700 in Houston. In this day & age of internet research, it's very unusual not tobe able to find somebody. Besides the cost of publication, you will have to pay for the absent party's attorney - usually about $700-$800. Might be cheaper to try to find the other person.

A divorce must be on file for a minimum of 60 days in Texas.

A divorce by publication is not hard, however, I've been doing family law exclusively for over 10 years.

James is right -- you will have to pay for an attorney to try to find your spouse.

Don't hire a private investigator to try to find your spouse! They are expensive.

I can do a search for you for $100.

Call her friends and family and try to find her -- it's easier and cheaper!
