Legal Question in Family Law in Texas

Divorce Question

I am a woman trying to get out of a twenty-six year marriage. But, I do not know how to go about doing it. My husband has put all of our bills in my name and this worries me. If we split are they all my responsibility? What about the house, do I get half of it? Is mental abuse grounds for a divorce? Thanks so much.

Re: Divorce Question

Hire an attorney. There are lots of issues that you may not see or know. This is a community property state and there is a presumption out there of a 50 50 split but the juge a great lattitude in changing that. There a pension plans and social security benefits that may need to be split. Are there any children under the age 18. If you are in the Dallas Fort Worth area I would be happy to talk to you 817 821-0945 is my cell phone number. Good luck and hire your own attorney. I cannot stress the need to be represented too much.

Re: Divorce Question

Basically, you are basically entitled to 50% of all assets and 50% of all liabilities that were accumulated during the marriage.

If you have not worked outside the home and do not have job skills to support yourself, you might be entitled to spousal support for up to 3 years in order to get job training.

Texas encourages no fault divorce.

Grounds like mental cruelty are used to ask for a disproportionate share of the estate.
