Divorce and Remarriage in Texas in the 60's
My in-laws are having a debate over the laws when they were divorcing their first mates in 1961 & 1970. My father in law, who obtained a divorce decree in 1961, said you could remarry right away with no wait time after the divorce was final. My mother in law said that when she was getting the anullment in 1970 (she was also pregnant at the time) her lawyer told her that her marriage wasn't legal due to her then husband hadn't waited the 6 months from his finalization of his divorce before marrying her. She was saying that there is a span of time you have to wait and my father in law is arguing this point. Please help me resolve this family conflict to obtain peace in their lives!! It would depend on what the law was at the time of the event in the state they lived in at the time. You could hire an attorney to do the legal research in order to know the answer.
Current Texas law says that you must wait 30 days after the divorce paperwork is signed by the Judge in order to get a new marriage license.
However, you can have the Judge also sign an order waiving the waiting period.
