divorce re-opened

divorce final 10/08 uncontested I was awarded the family home and all furnishings due to ex giving up all rights and interest to the property no mention in the divorce decree of refinance. when he recvd the original petition for divorce and citiation of waiver he stated he would only sign it unless if I wrote out a statement that I would refinance thehome. so I wrote the letter to him. Due to my poor credit rating and the home being upside down the refinance was denied. Ex has reopened the case saying I willfully have denied the agreement to refinance. I have advised him of all of this prior to the citation being issued to me that I was selling the home but it has to be short sold. Which will effect both of our credit
