Legal Question in Family Law in Texas

Divorce residency requirements

My daughter is divorcing. Until a week ago she has lived in Denton County for the last 5 years. She has moved to Collin County. Can she now file for a divorce in Denton County or does she need to live in Collin County for 90 days prior to filing there?

Re: Divorce residency requirements

To file for a divorce in Texas EITHER party must reside in Texas for at least 6 months and in the filing county for the past 90 days. Thus, if your daughter does not want to wait the requisite amount of time and her husband qualifies in a county, she may file in the county of his residence. The Denton and Collin areas are among the locations where I practice law. If your daughter wants a free phone consultation, have her to call my law office at 214-712-9242.
