divorce from over seas

i work over seas and i would like to file for a divorce. the state that my spouse lives in says that i do not fall under there state law and that i have to file from the state that i am from. i talked to the the state that i am from and they will not accept the paper work do to the fact that my spouse is living in a different state. my question is how can i file for the divorce?

You did not state which state your wife lives in. In California, you can file for a legal separation without a residency requirement. You only have to be present when you file.

Why hasn't your wife filed for divorce? She could file in which state she lives in and you could consent to jurisdiction. You need to be represented by an attorney before the action starts. Since your are out of the country communications with your attorney may be problem. Therefore you need to plan a head and have your plan to preceed with your case in place before any court action begins.
