Legal Question in Family Law in Texas
divorce settlement
I'm in the middle of a divorce in Texas. My husband has 2 retirement accounts, property, the house (in both our names) and I got student loans while going to school to supliment our family income. Shouldn't I get half of everything and he should help pay back those student loans?

Everything is negotiable in a divorce.
It is presumed that everything (debts and assets) are divided 50/50.
However, if he did not sign to be personally liable on loans then the lender will only look to you for repayment.
In other words, what the divorce decree states does not impact independent lenders.
If you don't have an attorney, you need one.
