Legal Question in Family Law in Texas
Divorce
My son is going through a very ugly divorce in Texas. His wife threatened to take the 4 children 350 miles away. He hired an attorney in order to have a TRO issued to temporarily keep the children in the county of residence until a Judge could decide on the permanent residence issue. Three days after the TRO was served on his estranged wife, and immediately before he was to appear before a Judge to have the TRO extended until the final hearing, his attorney advised him to sign a release, telling him there was no way legally he could force them to remain in the same county. Although dismayed by the turn of events and completely destraught, he signed the Rule 11. After family members were notified, we immediately hired another attorney, but he is not fighting to overturn the Rule 11. His estranged wife has now left with the children. Is there any legal remedy for the complete failure of his first attorney to give him adequate and correct legal advice which has resulted in his children being taken 350 miles away from his residence? She also took all the community property.

Re: Divorce
It sounds like there were things going on that your son didn't understand or didn't choose to share with you. Be that as it may be, the State Bar of Texas has the information for filing a grievance against an attorney on its website.
