Common law marriages can be publicly documented, but very seldom are. If not, to get a divorce, you would need to file for divorce like all other formal marriages. What you need to consult an attorney about is whether it is better for you to take the position that a marriage existed or not. Once you decide that question, the facts of your case would need to be analyzed to see how they support or do not support your position as to the existence of a marriage. I am a board certified specialist in the field of family law. I would be glad to meet with you and go over the facts of your case. If you are interested in visiting, please contact me directly.
