Legal Question in Family Law in Texas

divorce

does Texas law require alimony to the wife if she does'nt work, and would I be required to pay mortgage payments on the property that has both names listed as owner. I also have a child I know I'll have to pay child support. I only earn $11.00 an hour. Would we be required to put the property up for sale? Would I have to pay alimony?

Re: divorce

You asked some very difficult questions that I can't truly address in an email.

To discuss spousal support very basically -- Spousal support occurs when there has been recent domestic violence or the couple has been married more than 10 years. It normally lasts a maximum of 3 years.

You would pay child support based on your income.

You would also be ordered to pay health insurance on the kid plus 50% of all uninsured medical.

Is there any equity in the property? If so, each spouse is entitled to 1/2.

It sounds like you've not talked to a lawyer yet.

In Texas, all assets and debts are divided - around 50/50. Sometimes the percentages vary--technically a judge could order one spouse to keep all the assets and the other spouse to take all the debts, but it normally does not happen.

You need to consult with an attorney about your particular situation.

You might want to read the Houston Bar Association's website at www.hba.org and read their freee family law brochure.

Good luck!
