I'm in a divorce and wanted to ask if I can do a Deed of Trust to secure assumption myself? I am leaving the mortgage in my name because she cannot refinance. I was also told if she is two months late i can take back the house. Since free questions may not get a response Let me add more. I'm on disability due to a neck/back injury. I would suggest that you have your attorney draft the deed of trust to secure assumption, if for no other reason than to have him or her explain what it really does.
