Based on what you have written, you need to file a petition for divorce and then will have to provide service to your spouse pursuant to the Texas Rules of Civil Procedure (TRCP). There are exceptions to personal service listed in the TRCP and you may have to follow one of those. If my local law firm can assist you with this legal issue or any other legal matter, please contact us at [email protected] to arrange for an initial consultation.

You may need to do what is called a publication divorce. The Court will need to appoint an attorney to represent the missing party and there are other requirements, but a divorce can be achieved. If you want to know more, please contact me directly at [email protected]
