Legal Question in Family Law in Texas
divorce
My wife and I have been seperated for 3 years. We were married in 2002 and she left back to her family in 2003. I have lost contact with her and am wondering if I will need to track her down to sign the divorce papers or if I will be able to have the judge sign off on the divorce. I am joining the military and would like to have this done before I leave for boot camp in April. What is my best course of action?

Re: divorce
It can be done, but maybe not finalized before April. You have to demonstrate that you have exercised due diligence in trying to locate her, but have been unable to. The judge then will give permission to give her notice by posting at the courthouse. An attorney ad litem is appointed by the court to verify that her rights were protected. Then the court will grant the divorce. To make sure that all proceedings are proper, you should hire an attorney. TCL
